Reasons for cancellation of visa-residence permit in Romania

Bangladeshis are migrating to Romania for study, job and family visa. However, many are being detained in the country for various reasons, including trying to enter the Schengen border illegally, not complying with the work permit visa law. The reasons why an immigrant is at risk of having his residence permit and visa revoked are explained.

All legal structures of foreign nationals entering and residing in the territory of Romania are governed by a special ordinance or OUG. The entry, right of stay and obligations of foreigners are governed by the amended provisions of Article 194/2002 of this Ordinance.

For reasons that the immigrant's long-term visa application is not considered at the embassy or upon arrival in Romania:

Immigrants who apply for short-term visas and residence permits for long-term permits are not issued long-term permits if they do not meet all the requirements.

If an applicant uses false information, fake documents or any other illegal means while applying for Long Term Permit and National D Visa, his/her application will be rejected. Or the visa or residence permit obtained after arrival in Romania is proved to be cancelled.

A person who has previously been returned or expelled from the territory of Romania reapplying under a different identity during the ban is not replaced by a positive decision.

Long Term Visa and Permanent Residence Permit
Reasons why the Romania General Inspectorate for Immigration (IGI) revokes a long-term visa, residence permit or permanent residence permit and right of residence:

All types of residence permits are revoked if an immigrant threatens the public order of local residents or is sentenced to more than five years. If involved in any activity threatening the national security of Romania.

Work permit and temporary residence permit
Romania has long sought to enter the Schengen zone, Europe's free movement zone. Recently, the application of Croatia was accepted, but the application of Romania and Bulgaria was rejected.

Workers arriving on EU Blue Card, ICT and seasonal visas must be notified in advance in writing before receiving Romanian social benefits. A person may lose right of residence.

When an immigrant applies for Romanian citizenship and receives citizenship, all previous residence permits are considered invalid.

Student visa or higher education
Students coming to Romania for higher education initially receive a one-year temporary residence permit or TRC card.

These students can temporarily suspend their studies only with the permission of the authorities for justified reasons related to illness. Failure to do so will result in cancellation of the TRC card issued under the study condition.

If you do not meet the conditions, including employment, for a residence permit obtained after graduation, you are not allowed to settle in Romania.

On the other hand, a TRC card or short-term permit is revoked if a person who obtained a residence permit through marriage to a Romanian citizen is absent from Romania for more than six months in a year without legal conditions.

From the beginning of 2022 until March of this year, the Bucharest authorities have conducted a series of operations against irregular immigration and human trafficking. Several Bangladeshis have been detained at the Schengen border and for not complying with work permit rules.

Many Bangladeshis have been deported to Dhaka. These deportation proceedings are carried out with the help of Frontex, the EU external border agency.
